Terms of Service

These Terms of Service (the "Terms") constitute a binding agreement between you and Mongol AI ("Mongol AI", "we", "us" or "our"). By creating an account, purchasing credits or otherwise using the website mongolai.app and its related services (the "Service"), you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not use the Service.

The Service uses artificial intelligence to restore, enhance, colourise and generate images on the basis of photographs and instructions submitted by users. Results are produced by automated systems, and their content and quality depend on the material submitted. We may add, modify or discontinue features at any time.

• You must be at least 13 years of age to use the Service. If you are under the age of majority, you may use the Service only with the consent of a parent or legal guardian.
• You may register with an email address and password or through a third-party sign-in provider such as Google or Facebook. Your use of those providers is subject to their own terms.
• You must provide accurate information and keep it up to date.
• You are responsible for safeguarding your credentials and for all activity that occurs under your account. Notify us without delay at support@mongolai.app of any unauthorised use.
• Accounts are personal and may not be sold or transferred.

• The Service operates on a prepaid credit basis. Credits are deducted when a job is submitted. The number of credits required for each operation is displayed before you confirm it.
• Prices are stated on the website in Mongolian tugrik (MNT) and payments are processed through QPay. We may change prices at any time; changes do not affect credits already purchased.
• If a job fails for technical reasons, the credits deducted for that job are returned to your balance automatically.
• Credits have no cash value, are non-transferable, and expire 12 months after the date of purchase.

• Unused credits may be refunded on request within 7 days of purchase.
• Credits that have been used for successfully completed jobs are not refundable.
• Where the Service is defective or unavailable for reasons attributable to us, we will restore the affected credits or refund the corresponding amount.
• Approved refunds are made to the original payment method and are normally completed within 5 to 10 business days.

Refund requests should be sent to support@mongolai.app together with the relevant invoice details.

You agree not to use the Service to:

• upload, create or distribute content that is unlawful, defamatory, harassing, hateful or sexually explicit, or any content that sexualises minors;
• upload photographs of other persons without the right or consent required to do so;
• create images intended to deceive, impersonate or mislead others, including falsified identity documents and deceptive depictions of real persons;
• infringe the intellectual property, privacy or other rights of any person;
• circumvent usage limits, security measures or payment mechanisms, or access the Service by automated means without our written permission;
• resell or sublicense the Service without our written permission; or
• interfere with or disrupt the integrity or performance of the Service.

We may remove content and suspend or terminate accounts that violate this section, and may report unlawful content to the competent authorities.

You retain all rights in the photographs and instructions you submit. You grant Mongol AI a limited, non-exclusive, worldwide, royalty-free licence to host, reproduce and process that content, including by transmitting it to our AI processing provider, solely for the purpose of providing the Service to you. The licence ends when the content is deleted from our systems.

You represent that you hold all rights and consents necessary to submit the content and to have it processed as described in these Terms.

As between you and Mongol AI, and to the extent permitted by law, images generated for you by the Service belong to you. We do not use your content for marketing purposes or to train our own models.

Output is generated by automated systems and may be inaccurate, may not faithfully represent the persons or scenes depicted in the original, and may resemble output generated for other users. You are solely responsible for reviewing the output and for how you use it, including compliance with applicable law and the rights of third parties.

The Service, including its software, design, text, logos and trademarks, is owned by Mongol AI or its licensors and is protected by intellectual property law. Subject to these Terms, we grant you a limited, revocable, non-exclusive and non-transferable right to use the Service for your personal or internal business purposes. No other rights are granted.

The Service relies on third-party services, including sign-in providers, payment processors, cloud infrastructure and AI providers. We are not responsible for the acts or omissions of those third parties, and your dealings with them are governed by their own terms and policies.

We endeavour to keep the Service available but do not guarantee uninterrupted or error-free operation. The Service may be suspended for maintenance, upgrades or reasons beyond our control. Processing times and results may vary according to demand and the nature of the material submitted.

You may stop using the Service at any time and may request deletion of your account by emailing privacy@mongolai.app, as described in our Privacy Policy.

We may suspend or terminate your access, with or without notice, if you breach these Terms, if we reasonably suspect fraudulent or unlawful activity, if we are required to do so by law, or if your account has been inactive for more than 12 months. Where we terminate an account for reasons other than your breach, we will refund unexpired, unused purchased credits on request.

Provisions which by their nature should survive termination, including those on intellectual property, disclaimers, limitation of liability, indemnification and governing law, will continue to apply.

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Service will meet your requirements or that output will be accurate, complete or fit for any particular purpose.

To the maximum extent permitted by law, Mongol AI shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, revenue or goodwill, arising out of or in connection with the Service. Our total aggregate liability for all claims relating to the Service shall not exceed the amount you paid to us in the 12 months preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including the mandatory rights of consumers.

You agree to indemnify and hold harmless Mongol AI and its officers, employees and partners from any claims, damages, liabilities and expenses, including reasonable legal fees, arising out of the content you submit, your use of the Service, or your breach of these Terms or of the rights of any third party.

These Terms are governed by the laws of Mongolia. The parties will first attempt to resolve any dispute amicably through good-faith negotiation. Disputes that cannot be resolved in this way shall be submitted to the competent courts of Ulaanbaatar, Mongolia.

We may amend these Terms from time to time. The amended version will be published on this page with a revised effective date, and material changes will be notified to registered users by email or through the Service. Your continued use of the Service after the effective date constitutes acceptance of the amended Terms.

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our written consent; we may assign them in connection with a transfer of our business. These Terms and the Privacy Policy constitute the entire agreement between you and Mongol AI concerning the Service. Where the Mongolian and English versions differ, the Mongolian version prevails.
